What Should You Do If Someone Is Infringing On Your Mark?

The purpose of a Trademark is to establish true ownership of the name, logo, slogan, etc. that you seek to use. Your Trademark gives you the exclusive right to utilize your marks. Therefore, if someone else decides to use your mark(s) they are infringing. If you find that someone is infringing on your mark, you should notify them that they are infringing and retain my office right away to handle the matter on your behalf. If warranted, we can draft a cease and desist letter on your behalf and seek additional legal remedies if necessary. The exact steps taken will be determined on a case-by-case basis.
